These Terms of Service ("Terms") govern your use of Buy Me Sadza (buymesadza.com) (the "Platform"), operated by INTERSUPREME INNOVATION (PVT) LTD. ("we", "us", "our"). By creating an account, claiming a creator page, or sending a tip or subscription payment through the Platform, you agree to these Terms. If you do not agree, do not use the Platform.
1. WHO WE ARE
The Platform lets Zimbabwean content creators ("Creators") receive one-off tips and recurring subscription support from fans ("Supporters") via local payment channels (currently including EcoCash, ZB eWallet, OneMoney, InnBucks, Omari, and card, as enabled). We are a payment facilitator connecting Supporters and Creators; we are not a party to the underlying creative or personal relationship between them.
2. ELIGIBILITY
You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account. By using the Platform you confirm the information you provide is accurate and that you have the legal capacity to enter into these Terms.
3. ACCOUNTS
3.1 You are responsible for keeping your login credentials secure and for all activity under your account. 3.2 You must provide accurate registration information and keep it up to date. 3.3 One person or entity may not maintain more than one Creator account without our permission. 3.4 We may suspend or terminate accounts that violate these Terms (see Section 12).
4. CREATOR HANDLES AND VERIFICATION
4.1 Creators claim a unique handle (buymesadza.com/[handle]) to receive support. Handles are allocated on a first-come, first-served basis, except for handles we reserve (e.g. impersonating public figures, offensive terms, or reserved for platform use). 4.2 We may offer automated verification by sending a code to a Creator's social media account (TikTok, X, Instagram, YouTube, etc.). Submitting a handle for verification confirms you own or are authorized to represent that account. 4.3 We may reject, revoke, or reassign a handle or verification status at our discretion, including where we suspect impersonation, fraud, or a violation of these Terms. 4.4 A Creator's public page (bio, display name, avatar, links) must belong to them and must not infringe on anyone else's rights.
5. TIPS AND SUBSCRIPTIONS
5.1 Supporters may send one-off tips or subscribe to a Creator's recurring monthly tier. Amounts are set by the Creator (within any platform-defined limits) and displayed in USD. 5.2 Subscriptions renew automatically each period until cancelled by the Supporter. Supporters can cancel at any time from their account; cancellation takes effect at the end of the current billing period unless stated otherwise. 5.3 Tips and subscription payments are voluntary support to a Creator, not payment for goods or services, except where a Creator explicitly offers benefits (e.g. exclusive content) in exchange for a tier — in that case the Creator, not the Platform, is responsible for delivering what they promised. 5.4 We are not responsible for the conduct, content, or promises of any Creator.
6. FEES
6.1 We charge a platform fee, deducted from the amount a Creator receives, currently [5%] of each successful tip or subscription payment. This rate may change; the rate in effect at the time a payment succeeds is the rate applied to that payment and will not be changed retroactively. 6.2 Supporters are not charged a platform fee. Supporters may still be charged fees or levies by their payment provider or by statutory/government charges outside our control. 6.3 Payment channel providers (e.g. EcoCash, ZB eWallet) may charge their own transaction fees as part of completing a payment; these are not set or retained by us.
7. PAYOUTS
7.1 Creators may request a payout of their available balance once it reaches the platform's minimum payout amount (currently $[10.00] USD), subject to any payout hold period we apply. 7.2 We may delay, reduce, or withhold a payout where we reasonably suspect fraud, a Terms violation, a chargeback/reversal risk, or where required by law or our payment partners. 7.3 It is the Creator's responsibility to provide accurate payout details. We are not liable for funds sent to incorrect details supplied by the Creator.
8. REFUNDS AND CHARGEBACKS
8.1 Tips and subscriptions are generally non-refundable, as they are voluntary support rather than a purchase, except where required by law or where we determine a payment was made in error or fraudulently. 8.2 We may reverse a payment, deduct a corresponding amount from a Creator's balance, or recover funds already paid out if a payment is later reversed, disputed, or found to be fraudulent.
9. TAXES
Creators are solely responsible for determining and paying any taxes (income tax, VAT, digital services levies, or otherwise) owed on amounts received through the Platform. We may report or withhold amounts where required by applicable law.
10. DISCOVER AND PUBLIC LISTINGS
Creators who are verified, in good standing, and have opted in may appear on the public Discover page. We may remove any Creator from Discover at any time, including for policy violations, without removing their underlying account.
11. PROHIBITED CONDUCT
You may not use the Platform to: - Violate any applicable law or regulation; - Impersonate any person or misrepresent your affiliation with any person or entity; - Solicit or send tips in exchange for illegal goods or services; - Launder money or disguise the source or destination of funds; - Post or link to content that is unlawful, defamatory, hateful, sexually exploitative of minors, or infringing on someone else's intellectual property; - Manipulate or artificially inflate tips, subscriptions, or Discover placement; - Attempt to circumvent platform fees by directing payments off-platform after using the Platform to solicit them; - Interfere with or attempt to compromise the security or integrity of the Platform.
12. SUSPENSION AND TERMINATION
12.1 We may suspend, block, or terminate any account, and withhold any pending balance, if we reasonably believe these Terms have been violated, or as required by law or our payment partners. 12.2 You may close your account at any time; any available balance will be paid out subject to Section 7, less any amounts subject to a pending dispute or investigation. 12.3 Sections that by their nature should survive termination (including fees already earned, indemnification, and limitation of liability) will survive.
13. INTELLECTUAL PROPERTY
Creators retain ownership of the content they post on their page. By posting content, a Creator grants us a non-exclusive, worldwide license to display that content on the Platform (including on the Discover page) for the purpose of operating the service. The Platform's name, logo, and branding are our property and may not be used without permission.
14. DISCLAIMERS
The Platform is provided "as is" without warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free operation, and we do not vet or endorse any Creator's content, claims, or conduct.
15. LIMITATION OF LIABILITY
To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the Platform, or for the acts or omissions of any Creator or Supporter. Our total liability for any claim arising from these Terms is limited to the greater of $[100] or the fees we retained from your transactions in the [3] months before the claim arose.
16. INDEMNIFICATION
You agree to indemnify and hold us harmless from any claim arising from your use of the Platform, your content, or your violation of these Terms.
17. CHANGES TO THESE TERMS
We may update these Terms from time to time. Material changes will be published on this page with a new effective date, and where required, we will ask you to re-accept before continuing to use the Platform. Continued use after a change takes effect constitutes acceptance.
18. GOVERNING LAW
These Terms are governed by the laws of Zimbabwe, without regard to conflict-of-law principles.
